Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kawaii Candy ("we," "us," or "our"), including our website at kawaiicandy.ai and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

These Terms are effective as of June 21, 2026.

The Service is intended for users who are at least 18 years old. By using the Service, you represent that you meet this age requirement.

Mature content is off by default. Access to mature or NSFW content requires you to meet age requirements and complete our age verification and gating controls. We use these controls to keep mature content restricted to eligible adults.

You may not use the Service if you are prohibited from doing so under applicable law or if we have previously suspended or terminated your account.

You register with an email address, password, public handle, and age. You are responsible for keeping your credentials confidential and for all activity under your account.

Your handle becomes part of your public profile URL. Choose a handle you are comfortable sharing publicly.

Notify us promptly at [email protected] if you believe your account has been compromised.

• Passwords must meet our minimum strength requirements at registration.
• One person may not maintain multiple accounts to evade enforcement or limits.
• You must provide accurate registration information.

Kawaii Candy is an AI character roleplay platform. You can create characters, chat with AI personas, discover community content, subscribe to plans, purchase in-app credits, and participate in creator features such as tips.

Features, limits, and pricing may change over time. We will describe material changes in these Terms or through in-product notices where appropriate.

You retain ownership of content you create, including characters, personas, messages, comments, and profile information ("User Content").

You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely to operate, improve, and promote the Service, including making public content discoverable to other users according to your visibility settings.

You are responsible for your User Content and represent that you have the rights needed to post it.

• Public characters, profiles, and comments may be visible to other users and search features.
• Private or draft content is handled according to your settings and our Privacy Policy.

You agree not to use the Service for unlawful, harmful, or abusive purposes. We may remove content or suspend accounts that violate these Terms.

• No illegal content or activity.
• No harassment, threats, hate speech, or exploitation of minors.
• No impersonation of real people without permission.
• No attempts to bypass security, scrape the Service at scale, or interfere with other users.
• No malware, spam, or fraudulent payment activity.

Chat responses are generated by third-party AI models accessed through OpenRouter based on your prompts and conversation history. AI output may be inaccurate, incomplete, or inappropriate.

The Service does not provide medical, legal, financial, or other professional advice. Do not rely on AI responses for decisions that require professional judgment.

You use AI features at your own discretion. We do not guarantee specific response quality, availability, or factual accuracy.

Paid subscriptions and billing are processed by Stripe. By subscribing, you authorize recurring charges according to the plan you select until you cancel.

Subscriptions renew automatically at the end of each billing period unless canceled before renewal. You can manage or cancel subscriptions through your billing settings or the Stripe customer portal where available.

Cancellation stops future charges; access generally continues until the end of the current paid period unless otherwise stated.

Prices, taxes, and available plans may change. We will provide notice of material price changes where required by law.

Credits are in-app currency used for certain platform features. Credit packs are purchased through Stripe.

Credits have no cash value outside the Service unless we expressly state otherwise. Credits are generally non-refundable except where required by law or at our discretion in cases of billing error.

We may adjust credit pricing, usage rules, or feature availability. Unused credits may be subject to expiration or account-closure rules described at purchase or in your account.

Fans may tip creators to support their characters. Eligible creators can receive real-money payouts through Stripe Connect, subject to successful onboarding, identity verification, tax reporting, minimum payout thresholds, and Stripe payout schedules.

Creators are independent users, not employees or agents of Kawaii Candy. You are responsible for your own tax obligations and compliance with laws that apply to your earnings.

We may withhold or delay payouts if your Connect account is suspended, if tips are disputed or charged back, or if we reasonably suspect fraud or Terms violations.

• Stripe Connect onboarding and KYC are required before payouts.
• Platform fees, if any, will be disclosed during onboarding or at payout.
• Prohibited creator conduct includes fraud, illegal content, impersonation, and circumventing payout rules.
• In-app credits may still be used for other platform features separate from Connect payouts.

You may delete your account from account settings. Deletion permanently removes data linked to your account, including characters, chats, messages, personas, profile information, and tips history, subject to limited retention required for legal, security, fraud-prevention, or backup purposes.

Deletion is irreversible once processed. Backups and logs may persist for a limited period before being purged according to our retention practices.

The Service, including the Kawaii Candy name, logos, software, and design, is owned by us or our licensors and protected by intellectual property laws.

You may not copy, modify, or exploit our branding or software except as allowed by these Terms or with our written permission.

If you believe content on the Service infringes your rights, contact [email protected] with enough detail for us to evaluate the claim, including identification of the work and the allegedly infringing material.

We may suspend or terminate your access if you violate these Terms, create risk for other users, or where required by law or payment partners.

You may stop using the Service at any time. Sections that by nature should survive termination will survive, including payment obligations, disclaimers, and limitations of liability.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service.

Our total liability for claims relating to the Service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred U.S. dollars, except where such limits are prohibited by law.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Except where prohibited, disputes will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.

If you are a consumer in a jurisdiction that grants mandatory local rights, those rights are not waived where they cannot be waived by contract.

We may update these Terms from time to time. When we make material changes, we will post the updated Terms and revise the effective date.

Continued use of the Service after changes become effective constitutes acceptance of the updated Terms, except where further consent is required by law.
